GTGO Terms of Use

These Terms of Use (the "Terms") set out the conditions on which CarOwnersClub Inc. ("we," "us," or "our") provides the mobile application "GTGO" (the "App"). Please read these Terms carefully before using the App. By downloading, installing, or otherwise using the App, you agree to be bound by these Terms.
Article 1 (Definitions)
- "User" means any person who agrees to these Terms and uses the App.
- "Content" means text, images, videos, location data, vehicle information, and any other data transmitted or received through the App.
- "Vehicle Inspection Certificate Verification" means the process by which the User's status as a legitimate holder of a vehicle is confirmed based on information from the vehicle inspection certificate.
- "Club" means a user-group feature created within the App.
- "Touring Session" means the driving record data captured by the trip-recording feature of the App.
Article 2 (Account Registration)
- Use of the App requires account registration through methods we designate.
- Use of the App is limited to individuals who are at least 13 years of age. In accordance with the United States Children's Online Privacy Protection Act (COPPA, 15 USC §6501) and Article 8 of the European General Data Protection Regulation (GDPR), we do not accept account registration from individuals under the age of 13. Age is verified based on the year of birth provided at sign-up.
- The User shall provide truthful and accurate information at the time of registration.
- The User shall be solely responsible for managing their own account and shall not allow any third party to use it.
- If the User provides false registration information, we may suspend or delete the account.
- The User may hold only one account per person.
Article 3 (Vehicle Inspection Certificate Verification)
- The User may upload their vehicle inspection certificate (shaken-sho) by methods we designate when registering a vehicle.
- We will perform reconciliation of the vehicle inspection certificate information; however, we do not guarantee the complete accuracy of the verification result.
- The User shall upload only vehicle inspection certificates for vehicles for which the User has legitimate authority.
Article 4 (Handling of Location Data)
- The App acquires and shares location data based on the User's consent.
- The scope and method of sharing of location data may be controlled by the User through the in-App settings.
- We do not guarantee the accuracy of location data. Navigation decisions while driving must be made by the User at their own responsibility.
Article 5 (Subscriptions)
- The App offers a free plan and paid subscription plans. The contents of each plan shall be displayed separately within the App.
- Fees, payment methods, and renewal/cancellation conditions for paid plans shall be displayed separately within the App.
- Payments are processed through external payment service providers we designate. The terms of service of the relevant payment service shall apply separately to such payments.
- Subscriptions renew automatically. Cancellations must be made by the day before the next renewal date.
- If the User downgrades a plan and the resulting registered-vehicle count exceeds the new plan's limit, the User may be required to delete the excess vehicles.
Article 6 (Prohibited Conduct)
The User shall not engage in any of the following conduct in connection with the use of the App:
- Conduct that violates laws, regulations, or public order and morals;
- Conduct related to crime (including stalking and harassment);
- Dangerous operation while driving (operating a smartphone while driving is prohibited by law);
- Disclosing another User's location data to a third party without that User's consent;
- Impersonating another User, or using another person's vehicle inspection certificate information without authorization;
- Interfering with the operation of the App (including unauthorized access, reverse engineering, and similar acts);
- Harassment, defamation, discriminatory conduct, or other acts that infringe on the rights of others;
- Unauthorized commercial use (advertising, promotion, etc., without our prior written approval);
- Access using automated tools, bots, or similar mechanisms;
- Any other conduct we deem inappropriate.
Article 7 (Rights to Content)
- Copyright in Content posted by the User to the App shall remain with the User.
- The User grants us a non-exclusive, royalty-free license to use posted Content within the scope necessary to operate, improve, and promote the App.
- The design, logos, software, and other intellectual property rights of the App shall belong to us.
Article 8 (Account Suspension and Deletion)
- If the User violates these Terms, we may suspend or delete the account without prior notice.
- The User may request account deletion at any time from the settings screen within the App.
- After account deletion, we will process related data in accordance with our Privacy Policy.
Article 9 (Disclaimer)
- The App is provided "as is." We make no warranty, whether express or implied, as to the completeness, accuracy, reliability, or fitness for a particular purpose of the App.
- We assume no liability for disputes between Users (including those arising from location data sharing).
- We shall not be liable for indirect, special, incidental, or consequential damages arising out of the use of the App.
- The App does not assist with safe driving. Operating the App while driving is prohibited by law. We bear no responsibility for accidents arising from use of the App while driving.
- We shall not be liable for service interruptions caused by acts of God, communications failures, server failures, or any other cause not attributable to us.
Article 10 (Modification or Termination of the Service)
- We may add, change, or remove functions of the App without prior notice.
- We may terminate the App where unavoidable circumstances exist. In that case, we will provide reasonable advance notice.
Article 11 (Modification of Terms)
- We may modify these Terms as necessary.
- Modification of the Terms shall be made by notice within the App, and shall take effect when the User agrees to the modified Terms.
- Where there is a material modification, a consent dialog will be presented at App launch.
Article 12 (Governing Law and Jurisdiction)
- These Terms are governed by, and shall be construed in accordance with, the laws of Japan.
- Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court of first instance.

Article 14 (Quebec Bill 96 — French Language Notice)
- For Users residing in the Province of Quebec, Canada, a French version of these Terms is available at https://gtgo.app/fr/terms-of-use, in compliance with the Charter of the French Language (Bill 96).
- Where the French version of these Terms is offered, a User who is a resident of Quebec may rely on the French version. In the event of a discrepancy between the English and French versions, the version that the User accepted at registration shall govern the User's relationship with us, except where applicable Quebec law mandates otherwise.
- Users in France are also referred to the French version where applicable, in line with the Loi Toubon (Loi n° 94-665).
Article 15 (Application Store Terms)
- If the User obtained the App from the Apple App Store, the User's use is also subject to the Apple Media Services Terms and Conditions and the Licensed Application End User License Agreement (LAEULA), which shall, in case of conflict only with respect to the User's relationship with Apple, prevail over these Terms.
- If the User obtained the App from Google Play, the User's use is also subject to the Google Play Terms of Service.
- The User acknowledges that Apple Inc. and Google LLC are third-party beneficiaries of these Terms with respect to the LAEULA and Google Play Terms obligations, and that they have the right to enforce these Terms against the User in that capacity.
- To the extent any provision of these Terms is inconsistent with the rules of the application store from which the User obtained the App, the application store rules shall prevail solely to the extent of such inconsistency.
